These Terms of Service (“Terms”) govern your access to and use of the AI Workflow platform and services provided by AI Workflow Inc. (“we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms, our Privacy Policy, and our Acceptable Use Policy.
1. Acceptance of Terms
By accessing or using AI Workflow, you confirm that you are at least 16 years of age, have the legal authority to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Account Registration
- You must provide accurate and complete information when creating your account.
- You are responsible for maintaining the security of your account credentials and for all activity under your account.
- You must notify us immediately at security@aiworkflow.com if you suspect unauthorized access.
- We reserve the right to suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.
3. The Service
AI Workflow provides an AI-powered platform that helps non-technical users create, manage, and deploy automation workflows through hosted n8n instances. The Service includes:
- AI Workflow Builder: AI-assisted creation and editing of automation workflows.
- Template Library: Pre-built workflow templates for common use cases.
- Hosted n8n: Managed n8n instances for running your workflows.
- Workflow Sharing: Ability to share workflows with other users.
- Version History: Automatic versioning and backup of your workflows.
4. Credits and Billing
4.1 Credit System
Certain features of the Service require credits. Credits are consumed when using AI features such as workflow generation, AI chat, and AI-assisted editing. Your plan includes a monthly allocation of credits. Additional credits can be purchased as add-on packs. Credits have an expiration date as specified at the time of purchase or allocation.
4.2 Subscriptions
Paid plans are billed on a recurring basis (monthly or annual) through Paddle, our payment processor. By subscribing, you authorize Paddle to charge your payment method at the beginning of each billing period. Prices are displayed in your local currency and include applicable taxes as calculated by Paddle.
4.3 Cancellation and Refunds
- You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
- Unused credits from your plan allocation are not refundable and do not carry over after cancellation.
- Purchased add-on credit packs are non-refundable once credits have been consumed.
- Refund requests for annual plans may be considered within 14 days of initial purchase if no credits have been consumed.
4.4 Price Changes
We may change pricing with at least 30 days advance notice. Price changes will take effect at the beginning of your next billing period after the notice period. If you do not agree with a price change, you may cancel your subscription before the change takes effect.
5. Intellectual Property
5.1 Your Content
You retain ownership of the workflows, configurations, and content you create using the Service (“Your Content”). By using the Service, you grant us a limited license to host, store, and process Your Content solely for the purpose of providing and improving the Service.
5.2 AI-Generated Content
Workflows and content generated or modified using our AI features are considered Your Content. You are responsible for reviewing, testing, and validating any AI-generated workflows before deploying them. We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.
5.3 Our Intellectual Property
The Service, including its design, code, templates, AI models, and documentation, is owned by AI Workflow Inc. and protected by intellectual property laws. Templates provided through our library may be used within the Service but may not be extracted, resold, or redistributed as standalone products.
6. Acceptable Use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree not to use the Service in any way that violates applicable laws or regulations, infringes third-party rights, or constitutes abuse of the platform.
7. Third-Party Services
The Service integrates with third-party services including n8n, AI providers (OpenAI, Anthropic, Google), and payment processors (Paddle). Your use of these integrations may be subject to additional terms from those providers. We are not responsible for the availability, accuracy, or actions of third-party services. Workflows you create may connect to external APIs and services you configure — you are solely responsible for ensuring those connections comply with the terms of those services.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or security reasons. We will provide reasonable advance notice of planned downtime when possible. We are not liable for interruptions or losses caused by downtime.
9. Limitation of Liability
To the maximum extent permitted by law, AI Workflow Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that AI-generated workflows will be error-free, secure, or suitable for your specific needs. You are responsible for testing all workflows before deploying them to production environments.
11. Indemnification
You agree to indemnify and hold harmless AI Workflow Inc., its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
- By You: You may terminate your account at any time through account settings or by contacting support. Your data will be deleted in accordance with our Privacy Policy.
- By Us: We may suspend or terminate your account for violation of these Terms, the Acceptable Use Policy, non-payment, or if required by law. We will provide notice when reasonably possible.
- Effect: Upon termination, your right to use the Service ceases immediately. You may export your workflows before termination. Provisions that by their nature should survive (including Sections 5, 9, 10, 11, and 14) will survive termination.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through a prominent notice on the platform at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance. If you disagree with the changes, you may terminate your account.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Delaware. Nothing in this section prevents either party from seeking injunctive relief in court for urgent matters.
15. General Provisions
- Entire Agreement: These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and us.
- Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights to a successor entity.
